These Terms and Conditions ("Agreement") govern your use of the EZMAN Delivery mobile application ("App") and related services (collectively, "Services"). This Agreement is a legal contract between you ("User," "you," or "your") and EZMAN Delivery Services ("EZMAN," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
To use the App, you must be at least 18 years old. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use or suspected security breach. We reserve the right to suspend or terminate accounts that violate our terms, provide false information, or abuse the Services.
EZMAN Delivery connects users with partner merchants and delivery personnel. We do not prepare food or manufacture goods. Our platform facilitates transactions and manages logistics for orders.
Orders may be placed through the App and are subject to merchant availability. Products are marked up by 10%, and a service or delivery fee may apply. An additional 2.5% discount is agreed upon with partner merchants. All payments are made via the chosen method during checkout (e.g., cash on delivery, digital wallet). We reserve the right to refuse, cancel, or limit orders at our discretion.
Merchants are responsible for order accuracy and product quality. In the case of incorrect items, the merchant will incur a penalty of 20% of the order value, which EZMAN will use to issue a customer voucher. Delivery partners are responsible for the timely and safe delivery of orders. Any issues arising from delivery must be reported via the App.
We may offer promotions, discounts, or rewards specific to users or merchants. These are subject to availability and may be modified or discontinued at any time.
EZMAN provides merchants with daily sales reports. Settlements will occur every 5 days, based on the agreed terms. A daily operational cash bond ranging from PHP 10,000 to PHP 20,000 will be maintained and adjusted based on demand.
Users may not use the App for illegal activities Harass, defraud, or abuse other users Attempt to disrupt or compromise system integrity Violate any applicable law.
Users may upload content such as reviews or images. You retain ownership of your content but grant EZMAN a non-exclusive license to use it for promotional or operational purposes. Inappropriate content may be removed at our discretion.
All content, logos, trademarks, and software used in connection with the App are the property of EZMAN or its licensors. You are granted a limited, non-exclusive license to use the App for personal, non-commercial use.
Our App may contain links or integrations to third-party services. We are not responsible for their content, privacy practices, or terms. Use at your own risk.
We value your privacy. Please refer to our [Privacy Policy] for full details on how your data is collected, used, and protected in compliance with applicable laws, including the Data Privacy Act of 2012.
The App and Services are provided "as is." We make no warranties regarding availability, accuracy, or reliability. Your use of the App is at your own risk.
EZMAN shall not be liable for any indirect or consequential damages arising from your use of the Services. Total liability shall not exceed the amount paid by you in the last 30 days.
You agree to indemnify EZMAN from any claims or liabilities resulting from your misuse of the App, violation of these Terms, or infringement of third-party rights.
We may update these Terms at any time. Continued use of the App constitutes your acceptance of any changes. You will be notified through the App or email.
This Agreement is governed by Philippine laws. Any disputes shall be resolved by the courts located in the Philippines.
